Privacy Policy

Effective Date: 2026

Last Updated: 2026

IMPORTANT: This Privacy Policy describes how TakeByTake ("we", "our", or "us") collects, uses, protects, and shares your personal information. By using our platform, you agree to the collection and use of information in accordance with this policy.

We are committed to protecting your privacy and complying with applicable data protection laws, including CCPA, CPRA, GDPR, and LGPD.

1. Introduction

TakeByTake respects your privacy and is committed to protecting it through compliance with this Privacy Policy. This policy explains:

  • What information we collect
  • How we use that information
  • With whom we share it
  • Your rights regarding your personal data
  • How we protect your information

2. What Information We Collect

We may collect personal information including, but not limited to: your name, email address, IP address, location, browser type, and interactions with our site. We also collect device and usage data through cookies and analytics tools.

2.1 Required Information

To create an account and use our services, we collect:

  • Account Information: Name, email address, username/nickname, password (encrypted)
  • Profile Information: Profile picture (optional)
  • Content: Scripts, comments, posts, ratings, and other user-generated content you submit

2.2 Optional Local-Only Demographic Information

To help us understand broad voting trends, we offer an optional section where you may provide general demographic information:

  • Country of residence (broad region)
  • Age range (e.g. 18–24, 25–34)
  • Gender group (broad category)

This information is stored exclusively on your device (browser localStorage) and is never transmitted to our servers in identifiable form. When you vote on a poll, your device converts this data into a wide anonymous aggregate key (e.g. "BR_25_34_WOMAN") and we increment a counter for that group only. No individual vote, profile, or personal identifier is ever stored alongside this key.

Groups with fewer than 20 votes are suppressed from analysis to reduce any risk of singling out individuals. You may clear or change this information at any time from your profile settings.

2.3 Automatically Collected Information

We automatically collect certain technical information when you use our platform:

  • Log Data: IP address, browser type and version, operating system, referring URLs, pages visited, time spent on pages
  • Cookies and Tracking: See our Cookie Notice for details
  • Device Information: Device type, screen resolution, language preferences

3. How We Use Your Information

We use your personal information for the following purposes:

  • Service Provision: To create and manage your account, enable platform features, and deliver requested services
  • Communication: To send important notices, respond to inquiries, and provide customer support
  • Personalization: To customize your experience and provide relevant content
  • Security & Fraud Prevention: To detect, prevent, and respond to fraudulent activities, abuse, or policy violations
  • Analytics & Improvement: To analyze usage patterns, improve platform performance, and develop new features
  • Legal Compliance: To comply with applicable laws, regulations, legal process, or enforceable government requests
  • Advertising: To display advertisements, which may include personalized ads based on browsing data

4. IP Address and Technical Data Collection

Legal Basis: IP addresses are considered personal data under privacy laws such as GDPR, LGPD, and CCPA/CPRA. We collect and process this data based on our legitimate interests in operating and securing our platform.

We collect and store IP addresses as part of our standard server logs. This data is used to:

  • Security: Detect and prevent fraudulent activity, spam, abuse, and unauthorized access
  • Performance: Analyze site performance, diagnose technical issues, and optimize user experience
  • Geolocation: Understand geographic distribution of visitors (country/region level only, not precise location)
  • Compliance: Respond to legal requests and enforce our Terms of Use

Retention Periods: We apply the following maximum retention periods to IP address data, in accordance with the storage limitation principle (GDPR Art. 5(1)(e), LGPD Art. 16):

  • Page view tracking (duplicate view prevention): 90 days from collection
  • Account activity logs (login, registration, consent): duration of the active account plus 12 months after account closure
  • Security and audit logs (abuse, fraud, enforcement): up to 24 months from the event, or longer if required by applicable law or active legal proceedings

Data Sharing: Your IP address may be shared with trusted analytics providers (such as Google Analytics) and security services only when necessary for legitimate operational purposes. These providers are bound by strict confidentiality obligations.

Your Rights: You may request access to, correction, or deletion of your IP address data by contacting us at [email protected]. However, some IP logs may be retained for security and legal compliance purposes within the periods stated above.

5. Cookies and Tracking Technologies

We use cookies, web beacons, and similar tracking technologies to improve your experience and analyze platform usage.

We do NOT sell your personal information. However, we may share your information with third parties in the following limited circumstances:

  • Service Providers: Hosting providers, analytics services (Google Analytics), email services, CDNs, and other vendors who help us operate the platform. These providers are contractually obligated to protect your data.
