2. California Residents (CCPA/CPRA)

2.1 Right to Know

California residents have the right to request that we disclose:

  • The categories of personal information we collected about you
  • The categories of sources from which we collected your personal information
  • Our business or commercial purpose for collecting, selling, or sharing personal information
  • The categories of third parties to whom we disclose personal information
  • The specific pieces of personal information we collected about you

Response Timeline: We will respond to verified requests within 45 days (extendable by 45 additional days if necessary).

2.2 Right to Delete

You have the right to request deletion of your personal information, subject to certain exceptions (e.g., completing transactions, detecting security incidents, complying with legal obligations).

Note: Some information may be retained in de-identified or aggregated form, or as required by law.

2.3 Right to Correct

If you believe we have inaccurate information about you, you may request correction. This includes updating:

  • Name and contact information
  • Account details
  • Profile information

2.4 Right to Opt-Out of Sale or Sharing

Important Disclosure: We do NOT sell your personal information in the traditional sense (i.e., exchanging data for money). However, under CCPA's broad definition, sharing data with advertising partners for targeted advertising may be considered a "sale" or "sharing."

What We Share:

  • Cookie and device identifiers with advertising partners (e.g., Google Ads)
  • Usage analytics with third-party analytics providers
  • Social media integration data (if you use social login/sharing features)

3. Other State Residents

3.1 Virginia (VCDPA)

Virginia residents have similar rights to California, including the right to know, delete, correct, opt-out of sale, and opt-out of targeted advertising and profiling.

Effective Date: January 1, 2023

3.2 Colorado (CPA)

Colorado residents have the right to opt-out of targeted advertising, sale of personal data, and profiling for decisions that produce legal or similarly significant effects.

Effective Date: July 1, 2023

3.3 Connecticut (CTDPA)

Connecticut residents have rights similar to Virginia and Colorado, including the right to appeal denial of privacy requests.

Effective Date: July 1, 2023

3.4 Utah (UCPA)

Utah residents have the right to know, delete, and opt-out of sale and targeted advertising.

Effective Date: December 31, 2023

4. How to Exercise Your Rights

4.1 Submitting a Request

You may exercise your privacy rights by:

  • Account Settings: Some rights (correction, deletion) can be exercised directly through your account settings

4.2 Information Required

To verify your identity, we will ask you to provide:

  • Your name and email address
  • Enough information to locate your account (e.g., username, date of registration)
  • For deletion requests: Two-factor verification (security code sent to your email)
  • For sensitive requests: Additional verification (e.g., answering account security questions)

4.3 Authorized Agents

You may designate an authorized agent to submit requests on your behalf. The agent must:

  • Provide written authorization signed by you
  • Verify their own identity
  • Provide proof of authorization (power of attorney or notarized letter)

4.4 Response Timeline

Acknowledgment: Within 10 business days of receiving your request

Response: Within 45 days of receiving your request (may be extended by 45 additional days with notice)

Deletion: If approved, deletion will occur within 30 days of confirmation

4.5 Verification Process

To protect your privacy, we implement a strict verification process:

  • Registered Users: Must log in to verify identity
  • Non-Registered Users: Must provide matching information we have on file
  • High-Sensitivity Requests: May require government-issued ID verification (for deletion or sensitive information requests)

4.6 Denial and Appeal Process

Reasons for Denial:

  • Unable to verify your identity
  • Legal obligation to retain information
  • Request is manifestly unfounded or excessive
  • Exception applies (e.g., ongoing transaction, security incident, legal compliance)

Appeal Process (VA, CO, CT residents):

  1. If we deny your request, we will provide the reason and instructions for appeal
  2. Submit an appeal via email to [email protected] with subject "Privacy Appeal"
  3. We will respond to your appeal within 60 days
  4. If your appeal is denied, you may contact your state Attorney General to submit a complaint

5. Non-Discrimination

We will NOT discriminate against you for exercising your privacy rights. This means we will not:

  • Deny you goods or services
  • Charge different prices or rates
  • Provide a different level or quality of services
  • Suggest that you will receive different pricing or quality of services

Financial Incentives: We do not currently offer any financial incentive programs tied to personal information collection. If we do in the future, we will provide separate notice and obtain opt-in consent.

6. Children and Minors

6.1 Age Requirement

TakeByTake is intended for users aged 16 years or older. We do not knowingly collect personal information from children under 16.

6.2 COPPA Compliance

If we become aware that we have collected personal information from a child under 13 without parental consent, we will delete it immediately.

6.3 Parental Rights

Parents or guardians may request:

  • Review of their child's personal information
  • Deletion of their child's personal information
  • Refusal to permit further collection of their child's information
